Terms and Conditions
1. Customer represents to be at least 18 years of age and legally capable of entering into this contract under Virginia law.
2. Overtime will be permitted, upon vehicle availability, and rounded off to the next hour. Availability of overtime is not guaranteed. Overtime rates are non-negotiable and will be charged to the customer according to the GPS Tracking report for each limousine. Chauffeurs’ do not have the ability to waive overtime for any reason. Overtime is charged by the hour not prorated per minute. Credit card on file will be pre-authorized $300.00 for up to 30 passengers and $400 for 31-40 passengers, 1 day prior to the event date, for overtime and damages deposit. Authorization will be released upon completion of the post-trip inspection report by management within 48 hours of the events ending.
3. Minimum contract price is fixed once reservation is made. Early dismissal, downsizing, or shortening of rental hours, will not adjust the price. Minor changes to rental are approved upon availability and require 48 hour advance notice, additional fees may apply. Adding additional stops, not included in routing, during trip will result in additional $75 charge.
4. Customer agrees to pay a late charge of 2% per month for any unpaid balance or attributable damages, as defined below, and shall reimburse Company for its costs of collection, including attorney’s fees at 30% of the outstanding balance or at $250 per hour if the outstanding balance is over $3000.
5. There will be a $100.00 charge, per person, if the number of passengers increases from the original contract. Customer herby agrees to hold company, its agents, and employees harmless from any consequences of such wrongful use by Customer or Customer’s guests, including the cost to defend against the same.
6. The customer and chauffeur must inspect inside limo/party bus before and after each rental. Customer shall be responsible for any and all harm and damages, suffered by the company, its agents, employees, or third parties, including but not limited to the vehicle, in regard to cleaning, breakage, burns or other interior or exterior damage to extent of the actual cost to repair or replace, with a minimum charge of $200.00. If customer or customer’s guest smokes inside the vehicle, customer shall be charged $400.00 and the rental will be terminated immediately, without refund. NO EATING in the vehicles! Customer is responsible for any damage done by decorating the vehicle.
7. SMOKING, ILLEGAL -- USE OF ALCOHOL (if passengers are under the age of 21), &/OR NARCOTICS OR CONTROLLED SUBSTANCES ARE PROHIBITED AND WILL RESULT IN ADDITIONAL CHARGES AND IMMEDIATE TERMNATION OF THE TRIP. Sitting on the seat backs is prohibited and will result in an additional $300 charge.
8. Additional charges will be applied to the credit card on file to cover the initial administrative costs of any damages that occur. If the actual cost exceeds the initial charge, Customer shall be responsible for the difference between the additional charge and the actual cost. Smoking in the limousine: $400.00; Cigarette burns: $500.00; Ripped/damaged upholstery: $950.00 per tear/hole (not including additional materials/labor associated with damage); Damaged or Missing Sunroof/ Damaged TV or Radio: $850.00; Spillage of drinks: $200.00; Damaged Tiles: $400.00; Vomit: $250.00; Lost or broken glassware: $30.00 per glass; Lost or broken remote control: $250.00; Excessive mess in the limousine: $200.00. All buses and limousines are equipped with video monitoring systems that will record the activities in the passenger compartment of the vehicle through the entire trip.
9. Chauffeur has the right to terminate the trip, without refund, if he/she feels that the party is not abiding by the above rules or is putting the vehicle or the chauffeur at risk. Bottled beer is not permitted in the limousine; canned beer only! The company, or its designated representative, is hereby appointed customer’s attorney-in-fact to sign customer’s signature for additional charges to customer’s credit card for damages, overtime, &/or any charges due & not immediately paid by the customer & is expressly empowered & authorized to charge all costs resulting from damages to said credit card.
10. Except in the case of willful misconduct or gross negligence of company, its agents or employees, customer hereby waives any and all claims against company, its agents or employees for injury, loss, or damage, including consequential damages, to customer’s person or property from whatever cause. In addition, customer waives any right of subrogation with regard to the same.
11. Customer understands and accepts that Acts of God, unforeseen traffic, and severe weather conditions delay travel. There may be unexpected vehicle breakdowns and other unforeseen events beyond the control of the company, for which company shall not be liable to the customer. There shall be no recourse for any of the same. In the event of a vehicle breakdown, all efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent &/or customer refuses a replacement vehicle, no refund is due. If no replacement vehicle is available, refund shall be limited to the amount paid by customer. In case of an emergency, the company may subcontract rental to another limousine service. The company is not responsible to fulfill itineraries developed by the customer, which indicate a time that the customer expects to arrive at certain locations after the initial pick up time. Vehicle requests are not guaranteed as vehicles are sold/updated at the discretion of management. Customers booking transfers only will be sent a limousine/bus that will accommodate their number of passengers per company availability, requests are not guaranteed.
12. Neither the company, its agents nor its employees shall be liable for any personal property of the customer or the customer’s guests, which are misplaced, damaged or left in the vehicle. We encourage you to take all personal items from the limousine prior to exiting.
13. Whether you fill out the reservation form on our website, book over the phone or check out through the shopping cart, PAYMENT IN FULL will be taken out immediately after the reservation has been made. After completing the reservation, a contract will be sent to you - this contract is for security purposes ONLY - It still needs to be signed, but whether you sign it or not your reservation has already been confirmed, is NON-REFUNDABLE AND cannot be canceled. Once you have completed your reservation one of the three ways available you have given your consent and agreed to our terms and conditions and are locked into your rental agreement.
14. All quotes or price matches that have been sent out are ONLY GOOD FOR 48 HOURS. After that time frame the price given may be subject to change.
15. Cancellation Policy: Customer agrees to 100% non-refundable payment, cancellations must be in writing. Cancellation fee is 100% of the total rental price or $300.00 whichever is greater. DEPOSITS AND PAYMENTS ALWAYS REMAIN NON REFUNDABLE AND NON TRANSFERABLE WITH OR WITHOUT SIGNATURE ON CONFIRMATION. PAYMENT IN FULL will be taken out immediately after receiving this Reservation form upon us completing your reservation in our system. The only time we accept deposits is when your event is more than 1 month away. If deposit is accepted, all reservations must be paid in full 2 weeks prior to event date. Once price quote has been given and agreed upon, if customer chooses to make changes to reservation details (Start and End time, Itinerary Changes, Number of Passengers Etc.) Prices are subject to change.
16. The company reserves the right to institute and establish rules and regulations of guest conduct, which may be amended from time to time, including termination of rental, without refund, due to non-compliant guest conduct.
